Ou seja, em termos gerais, trata-se de um <\/span><b>conjunto de regras<\/b><span style=\"font-weight: 400;\"> que t\u00eam <\/span><b>for\u00e7a de lei<\/b><span style=\"font-weight: 400;\"> e servem para normatizar as <\/span><b>pr\u00e1ticas de uso de informa\u00e7\u00f5es <\/b><span style=\"font-weight: 400;\">considerado apropriado n\u00e3o <\/span><b>ambiente eletr\u00f4nico.<\/b><\/p>\n<p><span style=\"font-weight: 400;\">UM <\/span><b>Lei Geral de Prote\u00e7\u00e3o de Dados Pessoais (LGPD) <\/b><span style=\"font-weight: 400;\">entre em <\/span><b>vigor em setembro de 2020. <\/b><span style=\"font-weight: 400;\">Desde ent\u00e3o, o <\/span><b>Brasil <\/b><span style=\"font-weight: 400;\">entrar para o <\/span><b>rolo dos 120 pa\u00edses<\/b><span style=\"font-weight: 400;\"> que conta com uma <\/span><b>lei espec\u00edfica <\/b><span style=\"font-weight: 400;\">para um <\/span><b>prote\u00e7\u00e3o de dados pessoais.<\/b><\/p>\n<p><span style=\"font-weight: 400;\">UM <\/span><b>Lei Geral de Prote\u00e7\u00e3o de Dados Pessoais<\/b><span style=\"font-weight: 400;\"> veio para <\/span><b>regras de constitui\u00e7\u00e3o<\/b><span style=\"font-weight: 400;\"> sobre um <\/span><b>coleta de dados pessoais <\/b><span style=\"font-weight: 400;\">\u00e9 o seu <\/span><b>tratamento<\/b><span style=\"font-weight: 400;\">. Segundo a lei, <\/span><b>\u201cdados pessoais\u201d<\/b><span style=\"font-weight: 400;\"> s\u00e3o <\/span><b>informa\u00e7\u00f5es relacionadas <\/b><span style=\"font-weight: 400;\">um <\/span><b>pessoa natural identificada ou identific\u00e1vel <\/b><span style=\"font-weight: 400;\">e <\/span><b>\u201ctratamento de dados\u201d<\/b><span style=\"font-weight: 400;\"> s\u00e3o como <\/span><b>opera\u00e7\u00f5es <\/b><span style=\"font-weight: 400;\">realizado com esses <\/span><b>dados<\/b><span style=\"font-weight: 400;\">, como <\/span><b>coleta, acesso, processamento, utiliza\u00e7\u00e3o, armazenamento, reprodu\u00e7\u00e3o, controle da informa\u00e7\u00e3o, classifica\u00e7\u00e3o<\/b><span style=\"font-weight: 400;\">, entre outros. E o <\/span><b>n\u00e3o cumprir essas regras<\/b><span style=\"font-weight: 400;\"> pode responder em <\/span><b>Defensas significam.<\/b><\/p>\n<p>&nbsp;<\/p>\n<h3><span class=\"ez-toc-section\" id=\"O_que_acontece_com_a_empresa_que_descumprir_a_LGPD\"><\/span><strong>O que acontece com uma empresa que descumprir a LGPD?<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p><span style=\"font-weight: 400;\">\u00c9 natural que todos <\/span><b>lei <\/b><span style=\"font-weight: 400;\">seja acompanhado de <\/span><b>Seguran\u00e7a legal<\/b><span style=\"font-weight: 400;\"> no caso de eventuais descumprimentos de suas <\/span><b>normas em vigor<\/b><span style=\"font-weight: 400;\">. E isso n\u00e3o \u00e9 diferente com a <\/span><b>LGPD<\/b><span style=\"font-weight: 400;\">, que estabelece uma <\/span><b>emiss\u00e3o de notifica\u00e7\u00f5es e multas <\/b><span style=\"font-weight: 400;\">para como <\/span><b>empresas <\/b><span style=\"font-weight: 400;\">que n\u00e3o operam em conformidade com as <\/span><b>diretrizes constantes da lei.<\/b><\/p>\n<p><span style=\"font-weight: 400;\">Como <\/span><b>empresas <\/b><span style=\"font-weight: 400;\">pode <\/span><b>receber multas<\/b><span style=\"font-weight: 400;\"> que incidente em at\u00e9 4% sobre o valor do seu<\/span><b> volume de faturamento anual.<\/b><span style=\"font-weight: 400;\"> Como <\/span><b>organiza\u00e7\u00f5es <\/b><span style=\"font-weight: 400;\">que violarem os<\/span><b> pilares fundamentais da LGPD<\/b><span style=\"font-weight: 400;\"> ou n\u00e3o possu\u00edrem o <\/span><b>consentimento necess\u00e1rio dos seus consumidores<\/b><span style=\"font-weight: 400;\"> quanto \u00e0s <\/span><b>opera\u00e7\u00f5es <\/b><span style=\"font-weight: 400;\">com os <\/span><b>dados virtuais,<\/b><span style=\"font-weight: 400;\"> ser\u00e3o cobradas como <\/span><b>penaliza\u00e7\u00e3o <\/b><span style=\"font-weight: 400;\">o montante de at\u00e9 50 milh\u00f5es de reais.\u00a0<\/span><\/p>\n<p><b>San\u00e7\u00f5es financeiras <\/b><span style=\"font-weight: 400;\">de outros tipos foram inseridos em 2% sobre o <\/span><b>Faturamento anual.<\/b><span style=\"font-weight: 400;\"> Entre elas, est\u00e3o o que devem ser <\/span><b>aplicados <\/b><span style=\"font-weight: 400;\">quando como <\/span><b>empresas <\/b><span style=\"font-weight: 400;\">Esteja com eles<\/span><b> registros de dados<\/b><span style=\"font-weight: 400;\"> em desacordo com os <\/span><b>itens previstos na LGPD<\/b><span style=\"font-weight: 400;\"> ou n\u00e3o emitem a <\/span><b>notifica\u00e7\u00e3o relativa ao vazamento de informa\u00e7\u00f5es.<\/b><\/p>\n<p><span style=\"font-weight: 400;\">Portanto, quanto maior ai<\/span><b>nfra\u00e7\u00e3o referente \u00e0 utiliza\u00e7\u00e3o dos dados dos seus clientes<\/b><span style=\"font-weight: 400;\">, que uma <\/span><b>empresa <\/b><span style=\"font-weight: 400;\">comete, mais elevados podem ser os <\/span><b>valores de penaliza\u00e7\u00e3o<\/b><span style=\"font-weight: 400;\"> n\u00e3o h\u00e1 caso de haver um <\/span><b>emiss\u00e3o de multas graves<\/b><span style=\"font-weight: 400;\">, de acordo com a<\/span><b> LGPD<\/b><span style=\"font-weight: 400;\">.
